Probate actually means proving a will. However, probate more commonly refers to the process of administering an estate after someone dies. Whether the estate is testate (with a will) or intestate (without a will), the probate process begins with petitioning the court to have a person appointed as the personal representative of the estate, who then is responsible for gathering the assets, paying outstanding debts or disputing creditor’s claims, paying any inheritance that may be due, and distributing the estate according to the terms of the will or according to the laws of intestate succession where there is no will.
